These Terms of Use ("Terms") govern your use of the websites, tools, educational content, messaging channels and other services (together, the "Services") provided by X Capital Group Sdn Bhd (Company Reg. No. 202101027781 (1428081-H)) ("X Capital", "we", "us"). By accessing or using the Services you agree to these Terms. If you do not agree, please do not use the Services.
- Who We Are
X Capital Group Sdn Bhd is a company incorporated in Malaysia with its registered office at Sublot 40, Level 3, Block A2, Saradise Kuching, Off Jalan Stutong, 93350 Kuching, Sarawak, Malaysia. Our brands and programmes include Tradexprop, X Academy and X Labs.
- Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Services. By using the Services you confirm that this is the case.
- Educational Content and No Financial Advice
Content provided through X Academy, our websites and our communications is for general education and information only. It does not constitute financial, investment, legal or tax advice, and does not take into account your personal objectives, financial situation or needs. Trading and investing involve risk, including the loss of capital. Past performance is not indicative of future results. You should seek independent professional advice before making any financial decision. Nothing on our websites has been reviewed by the Securities Commission Malaysia.
- Accounts, Memberships and Payments
Some Services require registration or a paid membership. You agree to provide accurate information, to keep your login details secure, and to be responsible for activity under your account. Fees, billing cycles, renewals and refunds for any paid programme are set out at the point of purchase and form part of these Terms.
- Communicating with Us, Including WhatsApp
We communicate with prospective and current customers through our websites, email, telephone and messaging services including WhatsApp. When you message one of our official business numbers on WhatsApp:
- your messages are received through Meta's WhatsApp Business Platform and may be viewed by our employees and contracted sales staff, and by our internal systems;
- copies of the conversation (including any images, documents or voice notes you send) may be stored in our customer-relationship systems for follow-up, record-keeping, quality assurance and compliance;
- we will only send you marketing messages on WhatsApp where you have agreed to receive them, and you may opt out at any time by replying "STOP" or contacting us;
- WhatsApp's own terms and privacy policy also apply to your use of WhatsApp.
How we handle personal data collected through these channels is described in our Privacy Policy and Personal Data Protection Policy.
- Acceptable Use
You agree not to: use the Services for any unlawful purpose; attempt to gain unauthorised access to our systems or data; copy, resell or redistribute our content, courses or tools without written permission; upload malicious code; harass our staff or other users; or misrepresent your identity.
- Intellectual Property
All content, course materials, software, tools, trade marks and branding made available through the Services are owned by or licensed to X Capital Group Sdn Bhd. You receive a limited, personal, non-transferable licence to use them for your own purposes. No other rights are granted.
- Third-party Services and Links
The Services may link to or rely on third-party platforms (for example Meta/WhatsApp, payment providers, brokers or prop-firm platforms). We are not responsible for their content, availability or terms, and your use of them is at your own risk.
- Availability and Changes
We may modify, suspend or discontinue any part of the Services at any time. We aim to keep the Services available but do not guarantee uninterrupted or error-free operation.
- Disclaimer and Limitation of Liability
The Services are provided "as is" and "as available". To the fullest extent permitted by law, X Capital Group Sdn Bhd excludes all warranties, and shall not be liable for any indirect, incidental, consequential or special loss, or any loss of profits, data or trading losses, arising from your use of, or inability to use, the Services. Nothing in these Terms excludes liability that cannot be excluded under Malaysian law.
- Indemnity
You agree to indemnify X Capital Group Sdn Bhd against claims, losses and costs arising from your breach of these Terms or misuse of the Services.
- Termination
We may suspend or terminate your access to the Services if you breach these Terms or where required by law. Sections 3, 7, 10, 11 and 14 survive termination.
- Changes to these Terms
We may update these Terms from time to time. The current version will always be published on this page with its effective date. Continued use of the Services after a change signifies acceptance.
- Governing Law
These Terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising from them.
